CyberCrunch 2019 Earth Day Video Award

This contest is run by Commonwealth Computer Recycling LLC dba CyberCrunch, with its address at 1628 Roseytown Rd. Suite # 9 Greenburg, PA. 15601 (“CyberCrunch”).

The contest takes place in the U.S.A. Therefore, the laws of the Commonwealth of Pennsylvania exclusively apply to this contest regardless of the location from which the contestant takes part. All entries will be subject to Instagram's terms of use, which can be found at www.instagram.com.

1. Eligibility of Participants

a. Employees of CyberCrunch (including its affiliated companies) and their relatives are ineligible for participation in the contest.

b. The contest is only open to residents of the U.S.A.

c. CyberCrunch reserves the right upon its sole discretion to exclude contestants on valid grounds, such as but not limited to

i. violation of the rules of the contest;

ii. manipulation of the technical process or administration of the contest;

iii. undue conduct in the contest;

iv. false or misleading statements regarding participation in the contest, and

v. racist, sexist, or otherwise offensive expressions or content on participants’ social media channels.

d. Participants shall be no more than 13 years old:

i. Only contestants are allowed to participate in this contest, with the exception of participation through legal guardians or parents.  Contestants must use their parents or legal guardians’ Instagram account for and on behalf the minor(s).

2. Purchase Requirements

There is no requirement for a purchase of any good or service offered by CyberCrunch or any third party. The purchase of any such good or service does not increase the contestant’s chance of success in this contest.

3. Contest Procedure

a. Contestants parents or legal guardians need to upload one 30-second video on Instagram for and on behalf of contestant:

i. The contestant’s video must include the written hashtag #CyberCrunchRecycling.

ii. The contestant’s video must include references to electronics waste recycling.

iii. The contestant’s video must be in the MP4 file format.

iv. The art in the video is not permitted to violate U.S. copyright laws.

1. The contestants video must explaining why electronics recycling is important.

2. Contestants parent or legal guardian must submit their video via the form on the event landing page and include their parent or guardian’s name, their email, parents or legal guardians Instagram account and a copy of their Instagram video

3. Contestants parent or legal guardian must follow the CyberCrunchRecycling Instagram account to attend this contest.

4. There are will be two winners.

5. CyberCrunch will, at its sole discretion, designate certain people to act as judges. These judges will, at their sole discretion, determine the most thrilling, creative, and convincing video for the prizes. The judges’ decision is final, and there is no possible recourse to any court.

6. The winners parent or legal guardian will be contacted between May 10, 2019, and May 15, 2019. The winners parent or legal guardian will be informed by CyberCrunch via email. The winners parent or legal guardian are required to respond to the notification email within three days. A potential winner may be required to provide proof of ownership of the winning video. If a winner fails to respond in a timely manner, CyberCrunch reserves the right, at its sole discretion, to disqualify him or her and reassign the award to the contestant with the second-highest vote count.

7. Each participant parent or legal guardian agrees that in case of victory, his or her child first name, video and photo may be published by CyberCrunch, any of its social media channels, website and potentially the press.

8. Videos of contestants will be shared on CyberCrunch’s social media channels or related websites.

4. Contest Period

Video entries may only be uploaded between April 9, 2019, and May 7, 2019. The winners will be contacted between May 10, 2019, and May 15, 2019.

5. Eligibility of Videos

a. To be eligible, entries need to comply with the guidelines herein ("Guidelines"). Entries that do not fully comply with these Guidelines may be disqualified at CyberCrunch’s sole discretion from the contest:

b. A video may not contain material that violates or infringes any other rights, including but not limited to privacy, copyright, or trademark infringement. Any content in the video must be entirely original, created by the participant. The use of any content that is not original may result in the disqualification of the video, at CyberCrunch’s sole discretion;

c. A video may not in any way disparage CyberCrunch, any of its products or services, the contest, or any person or party affiliated with the contest, nor may it appear to promote any direct competitor of CyberCrunch;

d. A video may not contain content that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous;

e. A video may not include any threats to any person, place, business, or group;

f. A video may not invade the privacy rights or any other rights of any person, business, or group, and a video may not name or depict any third party without his or her permission;

g. A video may not contain text or imagery that promotes bigotry, racism, hatred, or harm against any group or individual or that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; and

h. A video may not contain material that is unlawful or in violation of any jurisdiction.

i. The Guidelines apply to the content of the video, its title, and its description.

j. CyberCrunch reserves the right to bar entries access to the competition without offering any indication of reasons and to remove previously approved videos. CyberCrunch assumes no responsibility for the contents of the video entries.

k. Upon participating, contestants agree to fulfill all terms of the Guidelines. Participants agree to release and hold harmless CyberCrunch from any third-party claims arising out of any violation of the Guidelines by participants.

6. Prize

The two winners of the prize will be selected to receive a check in the amount of $1,000 each.

7. Copyright

Participants transfer to CyberCrunch and their legal representatives the irrevocable, unlimited, worldwide, free-of-charge, non-exclusive, and transferable right to reproduce, disseminate, adapt, and edit in full or in part (especially with regard to the digitization or encryption of the contributions, including but not limited to video and/or other illustrations), in all known media and usage forms and with regard to protective rights also in all unknown media and usage forms, for any purpose, commercial or non-commercial, in particular worldwide for advertising, promotion, sales, and merchandising purposes, free of charge at its sole discretion. These rights extend to the name, picture, and photo of each participant in this context. In so far as copyrights are concerned, the conditions customary in the industry must be offered by the participant for still unknown uses. The participant agrees that he or she will not receive any compensation for the commercial use of his or her contribution. Legal claims remain unaffected. CyberCrunch is therefore also entitled to transfer the rights of use to third parties and to alter and adapt the participants’ contents.

8. Liability

a. To the extent permitted by law, CyberCrunch is not responsible for

i. Any incorrect or inaccurate information, whether caused by the participant, printing errors, or omission, or by any of the equipment or programming associated with or utilized in the contest;

ii. Technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in the phone lines or network, hardware, or software;

iii. Unauthorized human intervention in any part of the uploading process;

iv. Any technical or human errors that may occur in the administration of the contest or the processing of videos or photos; or

v. Any injury or damage to persons or property caused directly or indirectly, in whole or in part, from participants’ participation in the contest. If, for any reason, a participant’s video is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the participant’s sole remedy is another video in the contest. If it is not possible to submit another photo due to the discontinuance of the contest or any part of it for any reason, CyberCrunch, at its discretion, may elect to hold a random drawing from all eligible video or, as the case may be, received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded.

b. CyberCrunch is responsible for prize delivery but not for prize utility or quality.

c. The reporting and payment of any taxes on prizes, if necessary, is the sole responsibility of the winners.

d. As far as is permissible by law, CyberCrunch’s liability for damages is limited to gross negligence and intent.

e. Notwithstanding the foregoing, CyberCrunch shall be liable for any negligent breach of essential obligations, the violation of which endangers the attainment of the contractual purpose, or for the violation of obligations, the fulfillment of which is crucial for the proper execution of the contest or upon compliance with which the contractual partners trust. In this case, CyberCrunch shall only be liable for the foreseeable damage typical for the contract.

9. Privacy

a. Upon participation in this contest, participants agree to CyberCrunch’s use of the data delivered by participants for the purpose of the contest. CyberCrunch limits the collection and use of the data of participants (such as full name, age, or email) to the following purposes:

i. Sending participants general (non-marketing) commercial communications;

ii. Sending participants newsletters and other marketing communications relating to CyberCrunch’s business (participants can inform CyberCrunch at any time if they no longer desire marketing communications); and

iii. Delivering targeted advertising. We may use participants’ information to facilitate the delivery of targeted ads, promotions, and offers. Participants have the right to request that their personal data not be processed for marketing purposes.

e. Your privacy rights may be subject to the appropriate state and federal privacy laws, and by taking part in this Promotion, you agree to the terms stated in our Privacy Statement and the Terms and Conditions on our website, where you will find a full summary of why we need to process your personal data, what data we hold, how we use them, and your rights as a data subject.

10. Revocation, Termination, and Withdrawal

At any time during the contest, participants may opt to withdraw from the contest. Within a reasonable amount of time upon notification, CyberCrunch then will delete all data collected from the participant, including the uploaded video or photo. Participants may declare their withdrawal at any time to CyberCrunch, with its address at 1628 Roseytown Rd. Suite # 9 Greenburg, PA. 15601. The revocation of CyberCrunch’s right to use the participant’s personal data is possible at any time. However, such revocation will necessarily be followed by the exclusion of the participant from the contest.

11. Applicable Law and Jurisdiction

This Agreement shall be governed and construed solely in accordance with the laws of the U.S.A. and the Commonwealth of Pennsylvania without giving effect to conflicts of law principles thereof, and only the Westmoreland County District Court in the Commonwealth of Pennsylvania shall have jurisdiction in any conflict or dispute arising out of this Agreement.

12. Severability

If any term, provision, covenant, or condition of this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. The invalid, void, or unenforceable provision, covenant, or condition shall be replaced by a term, provision, covenant, or condition found valid or enforceable that comes as close as possible to the regulation it is replacing. The same shall occur if any term, provision, covenant, or condition shall be found missing in this Agreement so as to constitute a gap in the regulations.
